Terms & Conditions
This agreement is by and between Mailbox Plus, LLC, hereinafter, “mail service” and the following names: Hereinafter, referred to as “Applicant(s),” shall be governed by these terms to which each party agrees:1. By completing this form and USPS Form 1583 (notarized if not local), a copy of which will be made available to the USPS, the applicant appoints mail service as an agent for the receipt, for a period of time not to exceed that for which rent has been paid in advance. Applicants will pick up mail at least once per week or make other arrangements, in advance with mail service. The box holder is required to arrange in advance and provide a name for a person to pick up mail and/or packages, identification will be required for the individual to collect mail and/or packages, and we will not be held liable. If no prior arrangements are made or the person is not notated on account, no mail will be handed to the person. We do not take phone calls asking if and what kind of mail or packages are in a mailbox, this is a liability as well as a security issue.
2. Once the mail service has placed the applicant’s mail in the assigned mail holder, the mail shall be deemed delivered, and the mail service shall not be responsible for loss, theft, or damage. Mail service is not engaged in the delivery of mail and cannot be responsible for the failure of the United States Postal Service to deliver mail or to deliver it in a timely fashion or in undamaged condition. Packages are notated as they are received regardless of signed status by the carrier. We sign for everything that comes in NOT one particular package. We take every liberty to ensure that all packages that make it into our facility are accounted for and delivered to the recipient. We are not liable for packages that are not in our facility and you agree to hold Mailbox Plus, LLC harmless.
3. Applicant agrees to use services in accordance with mail service rules and in compliance with all US Postal regulations, as well as local, state, and federal statutes and regulations. Failure to do so may result in cancellation of service without notice, refund, or mail forwarding.
4. Applicant agrees that any package that is delivered to this facility understands that there is NO physical assistance available to move the package outside of our facility. You will need to come prepared with physical assistance if you are unable to handle package(s) on your own due to size or weight and the proper form of transportation. We do not provide equipment to move your packages.
5. Information provided by the applicant will be kept confidential and will not knowingly be disclosed without the applicant's prior consent, except for law enforcement or postal operation purposes, in which case the mail service intends to cooperate fully.
6. Applicant agrees to pay an initial setup fee of $15.00, as well as monthly service fees. Mailbox service fees are all due and payable in advance and the Applicant agrees that the mail center may hold mail and packages pending payment. There will be no pro-rations or refunds for the cancellation of any service at any time. Applicant agrees to pay a late payment fee of $10.00 if any payment is not received within ten (10) days of when due. In the event that an applicant receives an unreasonable volume of mail or packages the mail center's reasonable judgment, the mail service may require the applicant to pay an additional storage fee of $10 per week. The mail service reserves the right to increase the mailbox service fees in the event that the applicant adds additional individuals or entities to the names of those individuals or entities authorized to receive mail and packages at the mailbox pursuant to Form 1583.
*This mailbox is for the use of the approved applicants only, do not allow the use by anyone else without proper approval, paperwork, and payment to the mail center. All names not on the box can and will be returned to the sender.
7. Upon expiration, cancellation, or termination of the agreement, mail service will:
a. Re-mail (i.e., forward) applicants' mail for one (1) month, provided the applicant pays the postage, packaging material, and forwarding fees in advance. It is the applicant’s responsibility to make arrangements with the mail service to identify any mail forwarding needs prior to the expiration, cancellation, or termination of this agreement.
b. Retain the applicant's mail, other than Unsolicited Mail, at the mail service for a period of thirty (30) days during which time we will provide your first class mail to you for a charge of $15 per pickup.
c. Discard or destroy any “Unsolicited Mail” (e.g., bulk mail, mail addressed to “current resident,” “occupant” or similar designation; or coupons, advertising, or other promotional material) delivered to or remaining at mail service.
d. Refuse any package addressed to the applicant delivered by any carrier.
8. One (1) month after the expiration, cancellation, or termination of this Agreement, the mail service will:
a. Refuse any mail or package addressed to applicant and delivered to mail service.
b. Return to Sender, discard or destroy any of the applicant's mail or packages delivered to or remaining at the mail service, at our sole discretion.
Once the mailbox has expired, terminated, or canceled, all box holders must cease using the address for any current or future mail/packages. Box holders are to be diligent about getting mail directed to a new address in a timely manner. We are happy to help you with closing your box if you give us advance notice.
9. The term of this Agreement shall be the initial period paid for by the applicant and any renewal period paid for by the applicant from time to time. Renewal of this Agreement for additional terms shall be at the mail service’s sole discretion.
10. Per USPS regulations, certified, registered, insured or C.O.D. mail or parcels will be accepted by mail service on behalf of the applicant. Full, advance payment of C.O.D. charges must be made to mail service prior to acceptance of C.O.D. packages. Any written notice to the applicant required or permitted under this Agreement shall be deemed delivered twenty-four (24) hours after the placement of such notice in the applicant's mailbox or at the time personally delivered (a) on the next day after placing in the hands of a commercial courier service or the USPS for next day delivery, or (b) five (5) days after placement in the United States Mail by Certified Mail, Return Receipt Requested, postage prepaid and addressed to the applicant at applicant’s address as set forth in Form 1583, or on the date of actual receipt, whichever is earlier.
11. As an applicant's authorized agent for receipt of mail, the mail service will accept all mail, including registered, insured, and certified items. Unless prior arrangements have been made, the mail service shall only be obligated to accept mail or packages delivered by commercial courier services which require a signature from the mail service as a condition of delivery. Packages not picked up within fourteen (14) days of notification will be subject to a storage fee of $1.00 per day, per package, which must be paid before the applicant receives the package(s). In the event an applicant refuses to accept any mail or package, the mail service may return the mail or package to the sender and the applicant will be responsible for any postage or other fees associated with such return.
12. Applicant and all authorized persons within a mailbox agree to protect, indemnify, defend and hold harmless the mail service, Mailbox Plus, LLC, and their respective affiliates, subsidiaries, officers, directors, agents and employees from and against any and all losses, damages, expenses, claims, demands, liabilities, judgments, settlement amounts, costs and causes of action of every type and character arising out of or in connection, with the use or possession of the Mailbox, including without limitation, any demands, claims, and causes of action for personal injury or property damage arising from such use or possession, from failure of the U.S. Postal Service or any commercial courier service to deliver on time or otherwise deliver any items (mail, packages, etc.), from damage to or loss of any package or mail, or to the mailbox contents by any cause whatsoever, and from any violation by the applicant of applicable federal, state or local laws.
13. Applicant herein agrees that the total amount of liability of the mail service, if any, for any and all claims arising out of or related to this Agreement shall not exceed $25.00 regardless of the nature of the claim.
14. Applicants must use the exact mailing address for the mailbox without modification as set forth in Section three (3) of Form 1583. The Postal Service will return mail without a proper address with the box number clearly stated to the sender endorsed as “Undeliverable as Addressed.” An additional fee may be charged if mail is consistent without having the box number. Additionally, the mail is put in a separate bin until there is a time to research the mail and get box numbers, then deliver. This can delay mail by days, weeks, and even months and is of no liability to the facility. Examples of Address: 1051 NE 6TH STREET #_____ GRANTS PASS, OR 97526

15. Applicant understands that the United States Postal Service will not forward or, and will not accept a Change of Address. At the termination of service, applicants, if they wish mail forwarded after that date, shall provide mail service with a forwarding address and provide a credit/debit card to remain on file for the sole purpose of payment of mail forwarding fees. Otherwise, applicants must contact all persons/companies that send mail to the address on an individual basis.
16. Some of this contract may not be applicable to a Virtual mailbox.
